If content you posted on New Dimensions Web is removed due to a DMCA Takedown Notice, you have the option to file a counter-notification. This allows you to dispute the claim of infringement. Your counter-notification must be a written communication and include the following elements:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled. State the location where the material appeared before it was removed or access was disabled (e.g., the URL).
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which New Dimensions Web may be found.
- A statement that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
We will forward your counter-notification to the original complaining party. If they do not file an action seeking a court order against you within 10-14 business days, we may restore the removed content.
